Policy on Digital Millennium Copyright Act
Welcome to our website (‘Site’). We value the rights of intellectual property of others and in return, we expect the same respect for our rights. In line with the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c), a copyright owner or their representative can issue a takedown request to us through our DMCA Agent. As an internet service provider, we are protected under the ‘safe harbor’ rules of the DMCA, granting us immunity from copyright infringement claims. To submit a valid infringement claim to us, certain information must be provided:
Notification of Infringement – Claim
- A signature of the copyright owner or their authorized representative;
- Identification of the copyrighted work allegedly infringed;
- Identification of the infringing material with details to locate it;
- Contact details of the complainant including name, address, email, phone number, and fax number;
- A statement asserting that the material was used without authorized permission;
- A confirmation that the claim is accurate and the complainant is acting on behalf of the copyright owner.
According to Title 17 USC §512(f), misleading information in an infringement notification can lead to civil penalties. Takedown notices should be sent via our Contact page or email for swift action.
It’s important to note that we may disclose the identity and details of any copyright infringement claim with the alleged offender. By submitting a claim, you consent to this sharing of information.
Counter Notification – Material Restoration
If you receive a takedown notice for material due to copyright infringement, you can issue a counter notification to reinstate the material on the site. The counter notification must include:
- Your signature;
- Description of the removed material and its original location;
- A declaration, under penalty of perjury, that the material was removed due to error or misidentification;
- Your contact information, consent to jurisdiction, and acceptance of service.
Submit your counter notice through our Contact page. Email submissions are preferred.
Repeat Infringer Policy
Copyright infringement is taken seriously by us. As per the Digital Millennium Copyright Act, we maintain a record of DMCA notices from copyright holders and make efforts to identify repeat infringers. Accounts of repeat offenders will be terminated.
